How do they measure alcohol in the blood to determine if some in over the legal limit to drive ?
I'm not big alcohol drinker and so a wine gum will get me drunk, but for some reason this question popped into my head. It was the fact that I would not have to drink much to be effected that started me think that people's alcohol tolerance is different and they say you can have x amount and drive but can't see how that's right cause that would mean that I could technical drive, which I couldn't, as I can't drive anyway, and wouldn't as I personally think no one should be allowed to drink any alcohol then get into a car, when I could be effected by so little. So, if I had one drink and I was breathalysed would that show up as being legal or are those blowy things set so that they read in a way that can tell some other way, like a person not used to drinks blood would show up more alcohol per, what every they measure it in, so gets into the system quicker?
In Missouri, if you are over .08% blood alcohol, you are presumed to be too impaired to operate a motor vehicle. If you have less alcohol in your blood than that, but other things (such as the way you perform on the Field Sobriety Tests) show impairment, then you can still be charged and convicted of DWI.
It isn't all dependent on the Breath/Blood/Urine test. It's the "totality of the circumstances."
